By accessing or using the Express Vehicle Locators platform ("EVL," "the Service," "the Platform"), you ("Customer," "you," "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the platform or submit a service request.
These Terms constitute a legally binding agreement between you and Express Vehicle Locators ("EVL," "we," "us," "our"). Use of the platform constitutes acceptance of these Terms in full.
EVL offers vehicle advisory services to individuals seeking to acquire, trade in, or finance a vehicle. Our service tiers include:
All fees are flat and non-commission-based. EVL does not earn any compensation from dealers, lenders, or buyers.
All vehicle transactions occur directly between the Customer and the selling dealer, lender, or buyer. EVL is a technology and advisory service only. EVL's liability is limited to the service fee paid.
Service fees are as listed in Section 2. Fees are due upon execution of the EVL Service Agreement for the selected tier. Payment is processed prior to EVL commencing your advisory service.
EVL charges only the fees listed herein. We receive no referral fees, dealer incentives, kickbacks, or commissions of any kind from dealers, lenders, or buyers. Our compensation is solely the flat service fee paid by you.
By submitting payment, you acknowledge that the service fee compensates EVL for the advisory service itself — the search, market analysis, and guidance effort — and not for any specific deal outcome.
By using EVL's services, you agree to:
By executing the EVL Service Agreement, you engage EVL in an advisory capacity only. EVL is not your agent, attorney-in-fact, or representative, and no power of attorney is granted to EVL under these Terms or the Service Agreement.
EVL's role is limited to:
EVL does not, under any circumstances:
You are responsible for conducting your own negotiation and completing your own transaction directly with the dealer, lender, or buyer, using the tools and guidance EVL provides.
EVL makes no guarantee of any specific deal outcome, including but not limited to:
EVL's obligation is to make commercially reasonable efforts to fulfill the service requested. Market conditions, inventory availability, dealer cooperation, and lender decisions are outside EVL's control.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EVL'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE TOTAL SERVICE FEES PAID BY YOU TO EVL FOR THE RELEVANT SERVICE.
EVL IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST SAVINGS, OR LOSS OF OPPORTUNITY, EVEN IF EVL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
EVL is not responsible for the actions, representations, warranties, or performance of any dealer, lender, trade-in buyer, or other third party involved in your transaction.
If you cancel your service request before EVL has commenced active work (typically within 24 hours of payment), a full refund will be issued less a $25 processing fee.
Once EVL has commenced active search, analysis, or advisory guidance for your request, service fees are non-refundable. This reflects the labor and effort invested by EVL on your request.
If EVL identifies a vehicle or provides guidance that meets your stated specifications and you decline to proceed without reasonable cause, the service fee is earned and non-refundable. If EVL is unable to find a vehicle meeting your specifications after reasonable effort, a partial or full refund may be issued at EVL's discretion.
Refund requests for exceptional circumstances should be submitted to info@expressvehiclelocators.com within 30 days of the service date. EVL will review each request on its merits.
You agree not to use the EVL platform to:
All content, design, code, data, and materials on the EVL platform are the exclusive property of Express Vehicle Locators or its licensors. You may not reproduce, distribute, modify, or create derivative works without express written permission from EVL.
The EVL name, logo, and brand marks are trademarks of Express Vehicle Locators. Unauthorized use is prohibited.
In the event of a dispute arising from or related to these Terms or the services, the parties agree to first attempt resolution through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, in the State of Texas.
You waive the right to participate in a class action lawsuit or class-wide arbitration against EVL.
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action not subject to arbitration shall be brought exclusively in the courts of Texas.
EVL reserves the right to update these Terms at any time. Material changes will be communicated via email or prominent notice on the platform. Your continued use of the platform after changes are posted constitutes acceptance of the updated Terms. The "Effective Date" at the top of this document reflects the most recent revision.
